Intellectual Property Rights – Images of Artwork

The Musée d’art de Joliette (MAJ) displays images of numerous works of art on its website, some of which are still subject to copyright. To respect these rights, the Musée asks users not to reproduce the images posted on its site for uses other than fair dealing as outlined in the Copyright Act (for purposes such as private study, research, or education).

In such cases, the MAJ asks users to indicate the title of the work, the name of the artist, and any collection or copyright that may be mentioned.

It is forbidden to modify the images in any way that could impact the integrity of the work (e.g., cropping the image, adding new elements, changing the colours).

Under no circumstances should the MAJ be associated with a product, project, or company solely through the use of an image posted on its site.

Reproduction of the images for any purpose other than fair dealing as defined in the Copyright Act is strictly prohibited without prior authorization from the MAJ. A request for reproduction may be submitted to the MAJ by writing to communication@museejoliette.org.

In posting images of the works in its collection on its website, the MAJ assumes no responsibility for any recourse or claim that a third party may make, particularly with respect to copyright violations involving the use of an image in a way that is not permitted by law.

Declarations of Rights and Licences

The Musée d’art de Joliette uses the latter’s Public Domain (or Public Domain in Canada) Mark. Content that is clearly identified with one of these copyright marks may be used in accordance with the conditions specific to the mark. When use requires prior written authorization (licence), the interested party must contact the MAJ or the rights holder.

For all authorized use of the content, the user must mention the name of the artist or creator (if known) and the source (“Musée d’art de Joliette”), preferably with the inventory number, the name of the artist, the title of the work, the year it was created, the dimensions, or the URL of the content.

This work is protected by copyright and/or related rights. You are free to use the work in any way that is permitted by the copyright and related rights legislation that applies to your use. Public Domain

The Musée d’art de Joliette authorizes the free use of all images of archives and objects that are considered to be in the public domain, have been digitized, and are accessible online. These images are offered free of charge, without restriction, according to the associated notices.

An object is considered to be in the public domain when it is no longer protected by copyright. The images may be copied, shared, and modified unconditionally, even for commercial purposes. A high-resolution image of the object is available for download. However, compiling images to replicate a similar or competing service is prohibited.

In order to meet its copyright obligations, the MAJ seeks to contact the artist’s successors or licensees in cases where the rights holder cannot be located. The MAJ highly appreciates any relevant information to that end.

With the exception of the aforementioned terms concerning images of artwork, the Musée d’art de Joliette permits, without special authorization, the use of the content on its site for strictly personal purposes, on condition that the Musée d’art de Joliette is named as the source of the information.

All documents found on this site, including but not limited to texts, compilations, images, videos, audio, and multimedia documents and logos of the MAJ and its partners, are protected by the Copyright Act and by international agreements. Unless otherwise indicated, copyright applies to every document available on this site.

Any other use or reproduction of the content on this site, in any form whatsoever, including downloading, publication, reproduction on another site, distribution online, or use for public or commercial purposes, is prohibited without prior authorization from the MAJ. Accuracy of information

The MAJ guarantees the accuracy of the information at the exact moment it appears on its website, but not thereafter; it assumes no responsibility for any document, data, or other content once it has been altered or modified in any way, whether or not it has been downloaded. Furthermore, in the event of a discrepancy between an official text and the content of this site, the official text takes precedence.

Personal Information

If a site user chooses to voluntarily send personal information by email or through an electronic form, the MAJ will use only the information necessary to respond to the user’s message or follow up on their request.

In accordance with the Act respecting Access to documents held by public bodies and the Protection of personal information, the personal information provided will in no way be used to create user profiles, nor will it be communicated, copied, exchanged, or sent to a third party without the user’s consent.

The MAJ may compile statistics regarding the use of its website, but under no circumstances can users be personally identified. To that end, the MAJ reserves the right to use cookies to carry out the analysis required to evaluate traffic on its site.

When an online purchase is made through the site, the MAJ collects only the personal information required to process a current or future order. Credit card numbers and the personal information required for online payment are sent only to the external supplier responsible for processing online transactions, as outlined in the online purchasing policy. The MAJ does not keep any credit card numbers provided as part of an online transaction through the website.

Social Media

The MAJ invites users to interact with its social media. To make sure these platforms are used for their intended purpose, users are asked to follow some basic rules outlined in the MAJ’s netiquette policy.

Use of the Site by Minors

There is no minimum age for accessing the MAJ website. However, the MAJ wishes to emphasize that some of the images shown, while artistic in nature, may be considered inappropriate for young children. Parents and guardians are responsible for exercising the supervision they deem necessary to ensure that the minors for whom they are responsible use the site in an acceptable manner.

Users under 18 years of age must obtain permission from a parent or guardian before submitting personal information via the MAJ website. Since the MAJ cannot verify ages conclusively, users must conduct themselves in good faith.
